Equipment leasing and sustainability: ask for evidence

Separate financing structure from reuse, recycling and environmental claims when assessing an equipment lifecycle proposal.

The short answer

A lease is a financing arrangement, not proof of an environmental benefit. Evaluate the actual equipment use, collection, reuse, recycling and reporting process, and substantiate any claim you intend to make.

Separate three decisions

First, decide whether the equipment fits the operating need. Second, compare how to acquire or finance it. Third, identify what will happen during use and at retirement. These questions interact, but a favorable answer to one does not settle the others.

For example, an agreement might provide a clear return route while the business still needs to assess transport, useful life, energy use and the destination of returned assets. Do not reduce those questions to a label such as 'circular financing' without explaining what service or outcome supports the label.

Make claims narrow enough to verify

The FTC's Green Guides caution against broad, unqualified environmental benefit claims. A specific claim about a documented activity is more meaningful than a general promise that every leased asset is environmentally friendly.

Write down the exact statement your organization wants to make. Identify its boundary, evidence owner, measurement period and limitations. If a provider supplies a report, check which assets and processes it covers. A statement about one recycling operation should not silently expand into a claim about the entire project.

Ask who actually performs the service

Equipment collection, data sanitization, remarketing and recycling may be delivered by different organizations. Ask which entity holds any cited certification, what facility or process it covers, and whether it applies to your equipment. Clarify what documentation you receive and when. An asset register, collection confirmation and destination report answer different questions. Your contract should identify the relevant deliverables rather than leaving a marketing presentation to define operational responsibilities.

Do not copy European compliance claims into a U.S. project

French or European reporting rules and purchasing obligations should not be presented as general U.S. requirements. Where an organization operates across jurisdictions, its advisers should determine what applies to that entity and transaction.

  • What precise environmental outcome is claimed?
  • Which assets and activities are covered?
  • Who performs each service?
  • What evidence and limitations accompany the report?
  • Which rules actually apply to this organization?
