Equipment finance agreements
Equipment finance agreements: ownership-focused questions
Understand the questions to ask about an equipment finance agreement, including ownership, security interests, payment obligations and early payoff.
What is an equipment finance agreement?
An equipment finance agreement, often shortened to EFA, is generally discussed as an ownership-oriented financing arrangement. The customer finances equipment rather than planning to return it under a use-oriented lease. The actual agreement determines ownership, security interests and obligations; the label alone does not settle them.
Ask the provider to describe the structure in plain language. Identify who buys from the supplier, who holds title, what collateral is involved, and what releases or documents are supplied after the obligations are satisfied.
Compare the complete obligation
Review upfront amounts, the payment schedule, fees, taxes, insurance and any other charges. Ask whether early payoff is available and how the payoff amount is determined. Do not assume that paying early removes every amount scheduled for later payment.
If the equipment will remain useful beyond the term, compare the expected ownership position with other offers. Use the same equipment scope and payment dates; an FMV lease with a possible future buyout is not the same end position as an ownership-oriented agreement.
Keep classification separate
Ask your legal, tax and accounting advisers to review the documents. An EFA discussion does not establish a deduction, depreciation entitlement or accounting outcome. Leaseworld does not publish an EFA rate card or promise that its partners offer this structure for every project.
Questions before signing
Request written answers from the provider for the proposed transaction.
- Who owns the equipment and what interests secure payment?
- Is any payment due beyond the stated schedule?
- How are supplier disputes handled?
- What is the early-payoff process?
- Which release documents confirm completion?
